  1. OWNER RELATED COMMISSIONING ACTIVITIES: Chebeague Island Boat Yard LLC (CIBY) welcomes you to our facility. All owners are permitted to work on their own boats, but our liability insurance requires that no outside mechanic, worker, or professional help is permitted to work on a customer’s boat unless a prior arrangement has been made with the yard. We reserve the right to bill a service charge for the use of our facilities by all outside contractors. Boat owners doing their own work must keep the area around their boat clean at all times. All activities must be done in compliance with Federal and State requirements. All persons using any part of the yard’s premises do so at their own risk.
  2. YARD SERVICES: All services and storage are provided at the sole risk of the vessel owner. CIBY cannot be held responsible for loss due to fire, theft, vandalism, damage from the elements, or wear and tear. All work will be charged on a time and material basis unless a firm, fixed price and scope have been defined and agreed upon by CIBY and the owner of the vessel.
  3. WORK AUTHORIZATION: Submission of a spring commissioning form authorizes CIBY to perform the services outlined in the work order. The owner further authorizes CIBY to operate the vessel or any part/system on the vessel for the purposes of diagnostic or performance testing at the owner’s sole expense.
  4. PAYMENT: All invoices must be paid upon completion of work. Any balance not paid within 30 days or within the terms of the invoice will be assessed a late fee of 1.5% per month. Owner grants CIBY the right to refuse to launch or otherwise release the vessel to the owner or any third party until all fees are paid in full, including those related to paragraph 5. Any launch or release of the vessel without payment in full of all fees shall not be deemed a waiver of any right of CIBY to collect fees under this agreement or any other state or federal law.
  5. NOTICE OF LIEN: In accordance with the provisions of the Maine Marina Boatyard Storage Act (10 M.R.S.A.) and Federal Admiralty Law, a lien is created on the vessel along with any motor, trailer, and other related gear for rent, labor, or other charges, and for expenses reasonably incurred in the sale of that property under the provisions of the statutes and regulations. Owner agrees that in the event CIBY must pursue enforcement of the lien, the owner is responsible for all attorney fees and related expenses incurred by CIBY in collection of payment under this agreement.
